Use of Artwork
The purchaser assumes full liability for any claims arising from alleged or actual infringement of trademarks, copyrights, service marks, or similar intellectual property rights related to the artwork. Each distinct artwork file will be treated as a separate order.
**Proofs**: If proofs are not required, please specify this on your PO or inform our Purchase Order Team.
**PMS Color Matching**: Most products include complimentary PMS color matching for imprinting; however, slight variations between the proof and final product are acceptable and may occur. For specific PMS color details, refer to the product’s detail page. The factory reserves the right to select the most suitable imprinting method for the order. Exact matches for non-stock thread colors cannot be guaranteed.
**Order Duplication**:
We will make every effort to replicate orders as closely as possible, but 100% identical duplication cannot be guaranteed. A digital proof must be requested to confirm order details. If an order is processed without a requested digital proof, TOPWIN PROMO INC. will not be liable for discrepancies.
Refunds
No refunds will be issued for errors caused by the customer, including typos in imprint text, incorrect PMS color selection or approval, invalid shipping addresses, or missing order details.
- For late orders: Only shipping charges will be prorated. A full refund requires the customer to return the entire order in its original quantity (as per the invoice) to TOPWIN PROMO INC.
- **Claim Deadline**: All order complaints or issues must be reported within 15 days of receiving the product. Complaints submitted after this period will not be accepted. Customers are responsible for ground shipping costs when returning products.
Payment Terms
**Pre-Payment**: All orders require pre-payment before entering production.
**Net Terms**: Customers with approved Net 15 or Net 30 terms must pay within 15 or 30 days of the shipment date, respectively. TOPWIN PROMO INC. reserves the right to terminate Net Terms for customers with late payments. Accounts with unpaid balances 45 days after delivery may be referred to collections.
Shipping
**Split Destinations**: Contact our sales team for split shipping arrangements; additional split shipping charges will apply.
**Shipping Method**: Unless specified by the customer, we reserve the right to select the most appropriate shipping method (including overnight air) to meet the event date on your PO. We are not liable for carrier delays, but we will be responsible for the cost of goods if the shipper fails to deliver on time.
**Delays Due to Customer Actions**: Delays in artwork approval or failure to provide required confirmations will extend shipping and delivery times, for which TOPWIN PROMO INC. is not liable.
**Address Changes**:
- Requests to change the ship-to address must be received at least 2 days before the scheduled shipment date.
- TOPWIN PROMO INC. is not liable for lost or discarded orders due to incorrect addresses or zip codes, and no refunds will be issued for such cases.
- Post-shipment address changes are not permitted unless the error is caused by TOPWIN PROMO INC.; additional charges may apply in such instances.
Production
**Production Timeline**: Production begins on the next business day after artwork approval and receipt of payment. The day the order is received is not counted as a production day.
**Proof Turnaround**: Digital proofs (when requested) will be sent within 3–4 hours via email.
**Extended Production Time**: Additional working days are required for orders with multiple imprints or custom PMS color matches.
**Rush Orders**: Orders requiring fulfillment in fewer than 5 working days may be classified as rush service and are subject to rush pricing.
**Order Confirmation**: All orders are subject to inventory availability and factory acceptance based on our production schedule.
